If you are on this page, it probably means your visa has expired or, you simply would like to stay informed. For those last-minute action takers, do not panic, you have 90 days from the expiration date to apply for restoration of status. In this article, I will go over some key points for restoration of status and some key requirements that need to be met.

As mentioned above, you must submit your application within 90 days of the expiration date. For applicants who applied to extend their visa, but unfortunately were rejected, you will have 90 days from the date you received the refusal notice. It is crucial for you to explain in detail the reason you lost your status and provide documents to help your case.

To be an eligible applicant, you must not break any regulations. This means if you had a student visa, you complied to all the rules of a student visa (full-time student, work less than 20 hours a week, etc). This is very important for your application. In addition, during the time that it takes to process your application, you cannot continue your studies or work. During this processing time, you do not have a status.

Another key point is to remain in Canada while your application is being processed. If for some reason, you have to leave Canada, you will have to apply as a new entry to enter Canada.

The processing fee for restoration of status is $200 CAD. This is only for the restoration of status application. If you also require a study permit or work permit, you must pay the additional fee of $150 CAD or $155 CAD depending on which permit you need.

All restoration of status applications will go to CPC-E (Case processing center- Edmonton). The person reviewing your case will determine if you are eligible or not.

If yes, you will receive a visitor record. On this visitor record there will be a new date, which is when you must leave Canada. It will also state new conditions of your stay. This time, do not wait till the last minute! Be careful of the new expiration date.

If unfortunately, your application was refused, you must leave Canada on the date given to you by the officer. You may also apply for an admissibility hearing, but remember to have proper documents and solid reasons proving why your status should be restored.

In some cases, you may be required to provide additional information such as, medical exam or an in-person interview. If this is the case, do not worry, just make sure to follow instructions given by the officer.
